I quote, "The responsibility lies upon the user to not spread malicious, false or illegal material using the tracker." This tells me that TPB does not take responsibility for the content that is indexed using their tracker.

So, it is up to experts (read, not me) to decide whether TPB could feasibly screen their site for content that would be illegal. Also, before that, whether they can legally utilize a laissez-faire policy on tracked torrents as they are now.
Personally, I lean on the "No" side, but that's me. I'm not educated in law.

If you want anonymous P2P, you have to pay for it, or get it very slow(not as slow as limewire,BTW).
Or try loading RIAA ips into a firewall, but that does not work entirely.
